Sample Memoranda of Agreement Under the NHPA
Under the NHPA, if it is determined that a federal undertaking will
have an adverse effect on a property listed or eligible for listing in
the National Register of Historic Places, avoidance, minimization, or
mitigation of the adverse effect must be considered before the project
can go forward. Typically, the Commission and its applicant or licensee
enter into a Memorandum of Agreement (MOA) with the SHPO and other consulting
parties setting forth agreed-upon mitigation measures. Sample MOAs that
have been signed by the Wireless Telecommunications Bureau are provided
below. Although the substantive stipulations of each MOA must be negotiated
separately to address each situation, we encourage parties to follow the
format used in the samples when drafting MOAs.
